We inform you that the personal data being processed may consist of an identifier, such as name, identification number, location data, an online identifier or one or more distinctive elements concerning your physical, physiological, psychological cultural, economic or social identity, which are suitable for identifying the user or rather rendering identifiable, depending on the type of services requested (hereinafter only "personal data”).

Personal data processed through the Website are as follows:

  1. Navigation data

    1. computer systems and software procedures used to operate the Website will acquire, during their normal operation, some personal data, the transmission of which is implicit in the use of Internet communication protocols. This category of data includes: IP addresses, type of browser used, operating system, domain name and website addresses from which logins have been performed, information on pages visited by users within the Website, login times, single page visit duration, internal path analysis and other parameters related to the operating system and to the user's computer environment. PURPOSE AND LEGAL BASIS OF THE TREATMENT

3.1 Purpose: Providing the good and/or service requested by the user, managing contracts perfected by the user, completing all related administrative, accounting, tax and legal requirements, as well as fulfilling requests submitted by the user.

Legal basis of the processing: All treatments put in place for these purposes are necessary for the fulfillment of contractual obligations, and do not require specific consent from the interested party (art. 6 paragraph (1), lett. (b) and lett. (c) of the GDPR).

3.2 Purposes: Detecting your user experience for our platforms, products and services we offer, as well as ensuring the proper functioning of all web pages and their contents.

Legal basis of the processing: All treatments put in place for these purposes are based on a legitimate interest of the Controller (art. 6 paragraph (1), lett. (f).

3.3 Purpose: Sending commercial communications relating to promotions and/or offers for which you may be eligible.

Legal basis of the processing: All treatments performed for these purposes are carried out with the specific consent provided by the user, except for commercial communications relating to products and/or services which are similar to those already purchased and/or subscribed by the user, for which processing is based on a legitimate interest of the Controller (art. 6 paragraph (1), lett. (f).

3.4 Purpose: Performing analyzes and processing of information about the user, his preferences, habits, consumption choices and/or browsing experiences. This activity is also carried out through the use of technologies such as cookies (for more information, refer to the "Cookie Policy" of this Information).

Legal basis of the processing: The treatments put in place for these purposes consist in an analysis of elementary information related to your consumption preferences, through aggregation of data, for the sole purpose of obtaining anonymous statistical information. As for profiling carried out by third parties, the Controller declines all liabilities and invites you to consult the cookie policy.

Discussing the purpose referred to in point 3.3, it should be noted that if the Data Controller uses, for direct sales of its own products or services, the e-mail details provided by the interested party for the sale of a product, he could, in compliance to art. 130, paragraph 4 of the Code, omit to request consent of the interested party, provided that the products are similar to those sold and the interested party, after being properly informed, does not refuse such use, both initially or on the occasion of subsequent communications.

RECEIVERS OF THE PERSONAL DATA

Your personal data may be shared, for the purposes set out in section 3 of this Privacy Policy, with:

4.1. subjects which typically act as data controllers pursuant to art. 29 of the Code and 28 of the Regulations, namely: i) physical persons, companies or professional firms which provide assistance and advice to Mar.Pel. S.r.l. for accounting, administrative, legal, tax and financial matters; ii) subjects performing technical maintenance activities on our behalf; iii) credit institutions, insurance companies and brokers;

4.2. subjects, bodies or authorities to whom it is mandatory to communicate your personal data in accordance with the provisions of law, or orders from authorities;

4.3. persons authorized by the Owner, pursuant to art. 30 of the Code and 29 of the Regulations, to the necessary processing of personal data for performing activities which are strictly related to the provision of services, and are consequently obliged to confidentiality, or have an appropriate legal obligation of confidentiality.

It is possible to connect, through appropriate links, to other websites from our web portal. The Data Controller declines any responsibility regarding any request and/or release of personal data to third party sites, as well as for the management of authentication credentials provided by third parties.

STORAGE OF PERSONAL DATA

Personal data processed for the purposes set out in sections 3.1 and 3.2 will be kept for the strictly necessary time for achieving them. In all cases, due to these treatments being aimed at services supply, the Data Controller will keep personal data for the period of time which was envisaged and permitted by law for protecting its interests (Art. 2946 cc and ss.). and for the time required by the specific obligation or applicable law.

For the purposes set out in sections 3.3 and 3.4, your personal data will be processed for as long you do not oppose the processing. Further information regarding the data retention period and the criteria used to determine it may be requested by sending a written request to the Data Controller, at the addresses indicated in the "Contact" section of this information. For all cases, the Owner shall reserve the possibility of keeping your personal data for the period of time provided and allowed by Italian law for protecting its interests (Art. 2947 (1) (3) of the Civil Code.).

RIGHTS OF THE INTERESTED PARTY

The subjects referred to in the aforementioned personal data (so-called "interested parties"), have the right to exercise their rights according to the procedures and within the limits set by the current privacy legislation. In relation to the processing of your personal data, you have the right to ask Mar.Pel. S.r.l., in accordance with the contents of articles. 15, 16, 17, 18, 20 of the GDPR:

  • access: you may request confirmation of whether or not data processing concerning you is in progress, as well as further clarification of the information referred to in this Notice, as well as receiving those date, within reasonable limits;

  • correction: you may request to rectify or supplement data which you have previously provided us or otherwise in our possession, if inaccurate;

  • cancellation: you may request that your data acquired or processed by Mar.Pel. S.r.l. are canceled, if they are no longer necessary for our purposes or with no ongoing disputes or controversies, in the event of revocation of consent or opposition to the processing by you, in case of unlawful processing, or if there is a legal obligation to cancel them;

  • limitation: you may request limitation of the processing of your personal data, in the presence of one of the conditions referred to in art. 15, 16, 17, 18, 20 of the GDPR; in this case, your data will not be processed, except for storage, without your consent, except for what is stated in the same article in paragraph 2.

  • opposition: You can oppose the processing of your data at any time, based on our legitimate interest, unless there are legitimate reasons for proceeding with the processing which prevail over yours, for example for works related reasons or for our defense in court; your objection will always prevail over our legitimate interest in processing your data for marketing purposes;

  • portability: you may request to receive your data, or have them sent to another controller indicated by you, in a structured format, which is commonly used and readable by automatic devices

  • cancellation: meaning irreversible deletion of your data.

Furthermore, in compliance with art. 7, par. 3 of the GDPR, we inform you that you can exercise your right to revoke your consent at any time, without prejudice to processing lawfulness based on the previously granted consent. Finally, we shall inform you that you have the right to lodge a complaint with the Supervisory Authority, which is the Guarantor for the Protection of Personal Data in Italy.
